TERMS OF SERVICE OF ESIM IO

These Terms of Service (“Terms”) are a binding agreement between You (referred to herein as “the User”, “You” or “Your”) and Getverify LDA, a company incorporated under the laws of Portugal, located at Avenida do Infante, no. 50, 9004-521 Funchal, Madeira, Portugal (referred to herein as “Esim io”, “the Company”, “we”, “us” or “our”), concerning Your access to and use of Esim io’s Services (as defined below) via the Esim io website, related features and services, and other linked channels, mobile websites or applications (collectively, the “Platform”). Esim io may use Affiliates and third-party service providers to perform parts of the Services as permitted by these Terms.

BY ACCESSING THE PLATFORM, USING THE SERVICES, OR CLICKING “AGREE” OR “CONTINUE” YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT, YOU MUST NOT USE THE PLATFORM OR SERVICES. THE SERVICES ARE INTENDED FOR INDIVIDUALS 18+ WITH CAPACITY TO CONTRACT. IF YOU DO NOT AGREE WITH THE TERMS, YOU SHOULD IMMEDIATELY DISCONTINUE USING THE PLATFORM AND SERVICES.

The Platform can be accessed from various locations and jurisdictions. You are solely responsible for compliance with Applicable Laws in each location where You access or use the Services. Do not use the Services where such use would be unlawful or require registration or licensing that we do not hold.

You may not use this Platform and the Services if you: (i) do not agree to these Terms; (ii) are not of the age or have the capacity to be bound by these Terms in Your jurisdiction of residence; or (iii) are prohibited from accessing or using this Platform or Services or any of this Platform’s contents, products or services by applicable law.

Esim io enables the procurement, activation, and management of prepaid mobile data plans delivered through embedded SIM (eSIM) technology and, where made available on the Platform, an optional pay-as-you-go outbound voice calling feature (the “Calling Service”). We provide the Services on an “as-is” and “as-available” basis, without warranties of uninterrupted availability, performance, or fitness for any particular purpose, to the fullest extent permitted by law.

By accepting these Terms, You acknowledge that You have been given access to the Payment, Cancellation and Refund Policy and any other user terms or policies expressly incorporated into these Terms (together, the “Policies”), as well as the Privacy Policy and Cookie Policy. The Policies form part of these Terms to the extent expressly incorporated. The Privacy Policy and Cookie Policy describe how personal data, cookies and similar technologies are handled for transparency and compliance purposes and do not, by themselves, create contractual warranties or obligations beyond those expressly stated in these Terms or required by Applicable Law.

You assume all risk and responsibility for compliance with any applicable telecommunications, data privacy, consumer protection, export control, or other local and international laws associated with Your use of the Service.

Defined Terms and Interpretation
1. Capitalized terms used in these Terms shall have the meanings set forth in this Section or, where the context so requires, as expressly defined in other parts of these Terms. Any definition introduced elsewhere in these Terms shall apply equally throughout the entire document unless the context requires otherwise. Singular terms include the plural and vice versa; references to “including” shall mean “including without limitation.”
2. For purposes of these Terms:
  
  “Applicable Law” or “Applicable Laws” means all laws, regulations, binding regulatory requirements, court or governmental orders, and mandatory industry obligations applicable to the relevant party, Service, transaction, jurisdiction or use.
  
  “Affiliate” means any entity that directly or indirectly controls, is controlled by, or is under common control with Getverify LDA, where “control” means the direct or indirect power to direct the management or policies of an entity, whether through ownership, contract or otherwise.
  
  “Credits”, “IO Credits” means prepaid, non-monetary units issued by Esim io that may be used solely to offset fees for the pay-per-use consumption of Services or Content available on the Platform. Credits have no cash value, are non-transferable, non-exchangeable, and may not be redeemed for money or any other consideration. The purchase and use of Credits are governed exclusively by these Terms and the Payment, Cancellation and Refund Policy; they have no value outside the Platform.
  
  “Calling Service” means the optional pay-as-you-go feature made available through the Platform that enables a User to initiate outbound voice calls to supported telephone numbers in national or international numbering plans using third-party telecommunications infrastructure.
  
  “Call Rate” means the usage rate applicable to a Calling Service call, determined by factors including the destination country and the type of number or line called, and displayed on the Platform before the User initiates the call. A rate may be displayed on a per-minute basis for ease of comparison, while actual usage is charged on a per-second basis as described in these Terms.
  
  “Call History Data” means the called telephone number, date and time of a call, call duration, and call status processed in connection with the Calling Service.
  
  “Cookie Policy” means the cookie and tracking technologies policy of Esim io, as published and made available on the Platform and updated from time to time, which explains the types of cookies and similar technologies used on the Platform, their purposes, and how users can manage their preferences. The version of the Cookie Policy in force at the time of access or use shall apply.
  
  “eSIM” means an embedded subscriber identity module that is digitally integrated into a compatible device and enables the remote download, installation, and management of carrier profiles and data Plans through the Platform. An eSIM is device-bound upon installation, cannot be physically removed, transferred, or cloned, and operates in accordance with the applicable network operator’s technical and regulatory requirements.
  
  “Payment, Cancellation and Refund Policy” means Esim io’s policy, as published and made available on the Platform and updated from time to time, which sets forth the terms and conditions governing payment methods, billing, cancellation, credit expiration, and refund procedures for the Services. The version of the Payment, Cancellation and Refund Policy in force at the time of the relevant transaction shall apply.
  
  “Platform” means Esim io websites, web interfaces, and applications we operate.
  
  “Plan(s)” means prepaid data connectivity offerings made available on the Platform, including (i) Ready Packages, which provide a fixed data quota or validity period for a single upfront fee, (ii) Pay-As-You-Go data options, under which data usage is charged on a per-unit or per-data-volume basis and automatically deducted from the User’s available Credits balance, and (iii) Subscription Plans, which provide a recurring data allowance and/or validity period for a recurring fee, charged at the frequency disclosed at the time of purchase and, where applicable, automatically renewed unless cancelled in accordance with these Terms and Policies. Plans are data-only and do not themselves include voice, SMS, or emergency services. Plans are delivered through eSIM technology, are device-bound upon activation, and are subject to the limitations and conditions set forth in these Terms and the Payment, Cancellation and Refund Policy. The Calling Service is a separate feature and is governed by these Terms, including Annex 1 (Outbound Calling Specific Terms and Acceptable Use Rules).
  
  “Privacy Policy” means the privacy policy of Esim io, as published and made available on the Platform and updated from time to time, which governs the collection, processing, storage, and disclosure of personal, technical, and usage data in connection with the Platform and the Services. The version of the Privacy Policy in force at the time of access or use shall apply.
  
  “Provider(s)” means, third-party carriers, network operators, upstream suppliers, and technology partners.
  
  “Policies” means the Payment, Cancellation and Refund Policy and any other user terms or policies expressly stated on the Platform to form part of these Terms. The Privacy Policy and Cookie Policy apply to the processing of personal data and the use of cookies and similar technologies respectively, and should be read together with these Terms. Nothing in these Terms limits any rights or obligations arising under applicable data protection or privacy laws.
  
  “Services” means the eSIM procurement, activation, management, data connectivity, the Calling Service where available, and related features and support provided via the Platform.
  
  “Merchant of Record” means Jigle Bilgi Teknolojileri A.Ş.”Jigle”, Z3P LLP “Zotlo” or any other duly appointed payment, billing, or sales intermediary engaged by Esim io to process payments, issue invoices, or act as reseller of record for transactions made through the Platform. The Merchant of Record operates in accordance with these Terms and any applicable order confirmation, invoice, or accompanying agreement.
  
  “Users” means individuals who access or use the Services through Your account, integrations, or applications.
Description of Services and Fees
1. The Services enable You to purchase, activate, download, and manage data-only Plans via the Platform. Plans do not include voice, SMS, or emergency services. Such Plans may be offered directly by Esim io or through authorized third-party carriers and content providers. Separately, where made available, the Platform may provide the Calling Service, which enables outbound voice calls on a pay-as-you-go basis. The Calling Service may be offered directly by Esim io using third-party telecommunications infrastructure and is subject to country, destination, technical, regulatory, and Provider availability.
2. The Platform provides a unified interface where You can review active Plans, monitor data usage, or one time top-ups, deposit Credits and manage account settings.
3. From time to time, the Services may receive automatic updates, including bug fixes, enhancements, and new features, to maintain compatibility and performance. By using the Services, You agree to receive and install such Updates without additional notice.
4. To access and fully utilize the Services, You must maintain compatible hardware and software (latest versions recommended) and an active internet connection. Service performance may be impacted by device capabilities, network conditions, and Platform requirements; You are responsible for meeting these prerequisites. Compatibility may vary by device, carrier, and country of origin. We do not warrant compatibility for any specific device or configuration. Usage fees for the Services are deducted in real time from Your available Credits balance. You may add Credits at any time through the payment methods described in our Payment, Cancellation and Refund Policy.
5. To use an eSIM data Plan, You must ensure that Your device is carrier-unlocked, supports eSIM functionality, and is compatible with the Service; compatibility may vary based on device model, firmware, carrier configuration, region, or operating system updates, country of origin, and must be verified prior to purchase. A stable internet connection, a compatible eSIM device, and one or more valid payment methods including third-party or Platform specific options are required. You are solely responsible for the activation, installation, and provisioning of the eSIM. Esim io disclaims all liability for activation failures, device restrictions, provisioning errors, or issues arising from unsupported devices. If You use a third-party payment method, any cancellations or refund requests must be made directly through that third party’s system. Billing details for such transactions are available via Your third-party account. Installed eSIMs are device-specific and non-transferable; installation on a new device requires a new Plan or a discretionary reissue as set out in clauses 4.6.11 and 4.6.12 below.
6. If a Plan includes a defined data quota, access to data Services under that Plan will cease once the quota is fully consumed, even if the applicable validity period has not expired. If You have remaining Credits in Your account at the time of quota exhaustion, Your usage will automatically resume on a pay-as-you-go basis using Your available Credits balance at the applicable rates, without requiring separate consent. If you do not have sufficient Credits, no further data usage will be available until You purchase an additional Plan or add Credits to Your account, where such options are offered by Esim io. No refunds, credits, or price adjustments may be issued in connection with quota exhaustion, except where required by Applicable Law.
7. Esim io relies on third-party carriers, network operators, upstream suppliers, and technology partners to provide parts of the Services. For data Plans, Esim io may act solely as an agent and technical intermediary, as described in the applicable Plan details, and unless expressly stated otherwise Esim io is not a party to the contract between You and the relevant third-party Provider. For the Calling Service, third-party telecommunications providers supply network, routing, numbering and related infrastructure to Esim io. Unless the Platform expressly states otherwise, use of the Calling Service does not by itself create a separate retail contract between You and such Provider. To the fullest extent permitted by Applicable Law, Esim io is not responsible for, and disclaims liability arising from, a Provider’s independent acts, omissions, performance, network availability, routing, numbering, restrictions, outages or service failures, except to the extent directly caused by Esim io’s own breach or where such liability cannot lawfully be excluded or limited.
8. You acknowledge that the Services depend on third-party carriers, network operators, and other upstream connectivity or content providers (“Providers”), who may at any time and without notice to Esim io change pricing, restrict, suspend, terminate service to a country or region, or otherwise alter availability or cost. If a Provider materially increases its cost, ceases service, or otherwise makes continued delivery impracticable (including due to regulatory, commercial, or technical developments), Esim io may, in its sole discretion, suspend, change price, modify, or discontinue the affected Services or plans in that country or region. Esim io will use commercially reasonable efforts to promptly notify affected Users and, when feasible, issue a pro-rata credit for the unused portion of any affected Service. Any credit provided under this Clause is subject to the Payment, Cancellation and Refund Policy. Except as expressly provided in this Section 2.8, Your sole and exclusive remedy for interruptions, modifications, or discontinuations caused by Provider actions is the pro-rata credit described herein, and You hereby release Esim io from all other claims (including consequential, incidental, indirect, lost profits, travel disruption, expectation, or similar damages) arising from Provider cost changes, unavailability, or country closures.
9. Your purchase from Esim io depends on third-party Providers. You expressly accept in advance any price changes (including passthrough increases) and acknowledge that Providers may at any time change pricing, restrict, suspend, or terminate Service, or otherwise make delivery impracticable (including as a result of abrupt cost increases, country-level shutdowns, regulatory orders affecting Providers, or loss of connectivity). In all such events, Your only remedy, if any, shall be the pro-rata credit (where provided) described in Section 2.8; no refund, replacement, or additional remedy is owed to You, unless Esim io expressly agrees otherwise in writing. You waive and release Esim io from all other claims (including indirect, consequential, special, lost profits, expectation, or similar damages) arising from such events.
10. When using Esim io Services in any country, You agree to comply with all applicable local laws and regulations, including those relating to mobile device registration and telecommunications use. You are solely responsible for determining whether purchase, activation, or use is lawful in Your jurisdiction of residence or intended use. Esim io makes no representation or warranty as to legality, disclaims all implied warranties to the fullest extent permitted, and You assume all risk of unlawful use and agree to indemnify and hold Esim io harmless for any violation.
11. Esim io reserves the right, at its sole discretion, to modify, suspend, or discontinue any aspect of the Services, in whole or in part, with or without notice. Material changes will be communicated via the Platform or email to the address on file.
12. Data Plans do not provide voice calling or SMS messaging capabilities. Where available, the separate Calling Service supports outbound voice calls only; it does not provide inbound calling, SMS, a dedicated personal telephone number or any right to port, retain or receive calls on a number displayed to a call recipient. To the fullest extent permitted by Applicable Law, Esim io makes no guarantee regarding network availability, coverage, connectivity, call completion, audio quality, uninterrupted performance, or the availability of any particular destination or number type, all of which may depend on third-party Providers and destination networks. The Services are not intended for distribution or use in jurisdictions where such distribution or use would contravene Applicable Law or require a registration, authorization or licence that Esim io does not hold. You must not access or use the Services in such jurisdictions and remain responsible for compliance with laws applicable to Your use. The Calling Service is not intended to replace a primary telephone service. You must not rely on the Calling Service for emergency communications and must maintain an alternative means of contacting emergency services. Nothing in these Terms limits any mandatory emergency-access obligation under Applicable Law.
13. Esim io and its Providers may implement reasonable network management measures in compliance with Applicable Laws to maintain service quality, prevent fraud or abuse, or comply with regulatory requirements.
14. Unlimited Subscription Plans provide data access without a fixed data cap during each monthly usage cycle but do not guarantee any minimum speed, uninterrupted access or unrestricted tethering. These Plans are intended solely for reasonable personal and non-commercial use. To protect network integrity, availability and service quality, Esim io and its network Providers may apply reasonable and proportionate network-management measures in cases of network congestion, excessive or abnormal usage, automated usage, unauthorized resale, commercial exploitation, fraud, unlawful activity or any use that materially affects the network or other users. Such measures may include traffic prioritization, temporary speed reductions, tethering restrictions or temporary suspension of the affected Service. Applicable usage thresholds, speed limitations and other restrictions may vary by country or network Provider and will be specified in the relevant Plan details. Usage-based restrictions will reset at the beginning of the next monthly usage cycle, unless continued restrictions are reasonably required due to fraud, misuse or unlawful activity.
15. Calling Service
  1. The Calling Service is subject to Annex 1 (Outbound Calling Specific Terms and Acceptable Use Rules), which is attached to and forms an integral and inseparable part of these Terms. By accepting these Terms, You accept Annex 1 as part of the same agreement; no separate acceptance of Annex 1 is required unless Applicable Law requires a separate consent, acknowledgement or other procedure.
    
    2.15.2. Annex 1 sets out the feature-specific rules applicable to the Calling Service, including its nature and availability, caller identification, charging, permissions, call history, verification, third-party telecommunications infrastructure, emergency communications, acceptable use and enforcement. In the event of any inconsistency concerning the Calling Service, Annex 1 prevails with respect to those feature-specific operational and acceptable-use matters; the Payment, Cancellation and Refund Policy prevails with respect to payment, billing, cancellation and refund mechanics; and the remainder of these Terms continues to apply in all other respects.
Your Representations and Warranties
1. By accessing or using Esim io, You expressly represent and warrant that:
  1. You must be at least eighteen (18) years old. Use of the Service for any other person is strictly prohibited
  2. You possess the authority to bind yourself with these Terms without violating any other agreement to which You are a party;
  3. Your use of Esim io will comply with all applicable laws, regulations, and industry standards, including telecommunications, data protection, consumer protection, and export control requirements;
  4. You will not use Esim io for any unlawful, abusive, fraudulent, or unauthorized purpose, nor will You facilitate any such activity by others;
  5. All information You provide to Esim io is true, accurate, complete, and current, and You will promptly update any information that changes;
  6. You will not infringe, misappropriate, or otherwise violate any intellectual property, privacy, or other proprietary rights of Esim io or any third party.
  7. You are the authorized holder of the payment method(s) used on Your account.
2. Esim io reserves the right to suspend or terminate Your access to Esim io and delete Your account if You breach any of the foregoing representations or warranties, or if Esim io determines, in its sole discretion, that You are not eligible to access or use the Services.
3. You acknowledge and agree that it is Your sole responsibility to ensure that Your access to and use of Esim io complies with all applicable local, national, and international laws, regulations, and licensing requirements. We make no representation or warranty regarding the legality of Your use of Esim io in any jurisdiction, and You assume all risk and liability in this regard.
Purchase, Payment Models and Activation
1. You may complete Your purchase for Esim io Services through one of the following purchase models: (i) Pay As You Go or (ii) Ready Package, or (iii) or a monthly or annual Recurring Subscription Plan subject to the details below. In all cases, You may deposit Credits to fund future usage, or You may purchase Ready Packages, Recurring Subscription Plan directly where available. Direct purchases are deducted from Credits where applicable.
  1. Pay As You Go: Usage-based Services may be charged against Your Credits balance in real time. For mobile data, a pre-determined amount per GB or other disclosed data unit will be deducted from Your Credits in real time based on data consumption. Pricing varies depending on the country of use and will be displayed prior to usage. Calling Service usage is charged separately in accordance with clause 4.7 below.
  2. Ready Package: You select and purchase a data plan with a fixed GB quota and validity period, or any other plan stated and offered by Us. The total package fee will be immediately deducted from Your Credits upon confirmation.
  3. You may purchase any other recurring Plan offered by Esim io on a monthly or annual basis. Data entitlements under each Subscription are allocated in monthly cycles and unused data does not roll over to the following month.
  4. Unlimited Global Plans are subject to the reasonable fair use applicable at the time of use. Where fair-use limits are reached, connection speed, tethering or certain network features may be restricted for the remainder of the relevant monthly cycle.
  5. Subscription Plans may be used in the countries supported by the relevant Plan. The list of supported countries may be updated from time to time. Coverage, connection speed, availability and service quality may vary depending on the relevant country, local network Provider and network conditions.
  6. Unless expressly enabled on the Platform, an active Subscription Plan cannot be upgraded, downgraded, paused or transferred to another Plan. To use a different Subscription Plan, You must cancel the existing Subscription and purchase the new Plan separately.
  7. Payment, automatic renewal, cancellation, failed payment and refund terms applicable to Subscription Plans are governed by the Payment, Cancellation and Refund Policy.Credits may expire as indicated in the Payment, Cancellation and Refund Policy or as shown at purchase; expired Credits are not refundable or redeemable.
2. Purchases on the Platform may be processed and billed by Jigle or Zotlo acting as our Merchant of Record and authorized reseller, or by another duly appointed intermediary (each a “Merchant of Record”). In such cases, payment is deemed made when the Merchant of Record successfully processes your transaction; your order confirmation/invoice will identify that Merchant of Record. The Merchant of Record may perform fraud screening, sanctions/KYC checks, or place temporary holds, and may manage chargebacks and reversals in accordance with card network rules and applicable law. All payments are governed by these Terms, the Payment, Cancellation and Refund Policy, and the Merchant of Record’s/processor’s applicable terms. Any approved refund will be processed via the original payment method by the relevant Merchant of Record and may take up to thirty (30) business days, subject to processor timelines and any shorter mandatory deadline under Applicable Law.
3. Payment
  1. By completing a purchase via the Esim io Platform, You enter into a binding transaction with Esim io or, where expressly identified at checkout or in the applicable order confirmation, the relevant Merchant of Record acting as seller or reseller of record for that transaction. In all cases, Your access to and use of the Services remain governed by these Terms and the applicable Policies, and the identity of the seller or Merchant of Record does not expand Esim io’s obligations beyond those stated in these Terms.
  2. Esim io may from time to time offer time-limited trial access to selected plans or features at no charge. Eligibility, duration, and feature scope of trials are determined solely by Esim io and may be subject to additional limitations.
  3. All fees, whether for one-time purchases, data top-ups or Credit uploads are charged at the time of transaction using Your selected payment method. You authorize Esim io and its authorized payment processors to charge all applicable fees, including taxes, duties, and surcharges.
  4. Prices, Plan availability, and tax obligations may vary by jurisdiction and are subject to change at any time prior to purchase. You will be presented with a complete cost breakdown, inclusive of VAT and any applicable regional surcharges, before confirming a transaction.
4. Refunds and Cancellations
  1. In respect of data Plan and eSIM purchases made directly through the Platform and MoR (and not through an app store if available), all sales are final once the eSIM has been provisioned, except where otherwise required by Applicable Law. Refunds, cancellations, or monetary claims for such purchases are handled through the applicable sales channel or Merchant of Record in accordance with the Payment, Cancellation and Refund Policy. Except where required by Applicable Law, we do not offer refunds or credits for unused data, expired Plans, or partial billing periods. For the avoidance of doubt, eSIM provisioning or activation does not, by itself, create or extinguish any Calling Service billing-correction, cancellation or refund right; such matters, including the treatment of unused Credits, are governed exclusively by the Payment, Cancellation and Refund Policy and Applicable Law.
  2. Refund requests for purchases made via mobile platforms such as Apple App Store and Google Play Store are governed by the applicable app store’s then-current refund process and Applicable Law; You should be aware that no refund will be issued solely because an account is deleted following a breach of these Terms, except where required by Applicable Law. All charges include VAT unless otherwise specified. You may not offset any claims against Esim io except where Your claims are undisputed or confirmed by final court judgment, subject to any mandatory right of set-off or withholding under Applicable Law.
  3. If You are benefiting from a free trial must cancel before the trial period expires to avoid being charged. Upon cancellation, trial access ends immediately, and no subsequent refunds will be processed.
  4. If You are a consumer in the EU or UK, by requesting provisioning or activation of the relevant data Plan or eSIM during any statutory withdrawal period, You expressly request immediate performance and acknowledge that, to the fullest extent permitted by Applicable Law, any right of withdrawal may be lost at the time and subject to the conditions prescribed by Applicable Law. Once the relevant data Plan or eSIM has been provisioned or activated, no refund is available except where expressly required by Applicable Law or the Payment, Cancellation and Refund Policy. This clause applies to data Plan and eSIM provisioning and does not govern Calling Service billing corrections, cancellation, refund or statutory withdrawal rights, which are governed by the Payment, Cancellation and Refund Policy.
  5. If a charge is disputed, charged back, reversed, or suspected as fraudulent, we (or the Merchant of Record) may suspend or terminate the affected Plan(s) or account and offset any Credits against amounts owed, subject to Applicable Laws.
  6. Refunds or credits are not available due to device incompatibility, device change, loss or theft, factory reset, or failed attempts to transfer an installed eSIM to another device. Any reissue is governed exclusively by clauses 4.6.11 and 4.6.12 and may incur fees.
5. All matters relating to payments, billing, renewals, cancellations, credit expiration, chargebacks, and refunds are governed by the Payment, Cancellation and Refund Policy. That policy forms an integral and inseparable part of these Terms. In the event of any inconsistency between these Terms and the Payment, Cancellation and Refund Policy with respect to payments or refunds, the Payment, Cancellation and Refund Policy shall prevail.
6. Registration, Activation, Compatibility, and Tax Obligations
  1. To access certain features of the Esim io Platform or utilize the Services, You may be required to register for an account and provide specific information. During registration, You may be asked to provide information including, without limitation, your name, email address, organization, tax id, billing details, and other data reasonably necessary to verify your identity or manage your account. Esim io may, at any time, request additional information, documentation, or verification to ensure compliance with applicable law or internal security standards. Failure to provide requested verification may result in delayed provisioning, suspension, or cancellation.
  2. Esim io may impose additional terms and conditions regarding account eligibility or access to particular features. We reserve the right to deny, suspend, or revoke account access at Our sole discretion.
  3. If authentication features such as passwords or one-time passwords (OTP) are enabled, You are solely responsible for safeguarding Your credentials. By using OTP, You agree to receive such messages from Esim io. You must immediately notify Esim io of any unauthorized access. To the extent permitted by law, You are fully responsible for all activities conducted under Your account.
  4. For access to the Calling Service, Esim io may also require country-specific telephone-number verification or other proportionate verification steps for fraud prevention, security or telecommunications compliance. Such verification may be carried out by a third-party verification provider and is governed by the Privacy Policy.
  5. You are obligated to provide accurate, complete, and current registration information, and to promptly update it if there are changes (including Your contact details). Failure to do so may result in failed or delayed communications. Notices sent to the last provided contact information shall be considered valid.
  6. Any personal data submitted via the Platform is processed in accordance with applicable data protection laws and the Esim io Privacy Policy.
  7. By registering, You consent to receive service-related communications, including alerts and notices, via the contact details provided to Esim io.
  8. Esim io may process anonymized and aggregated data, including usage metrics, for internal analysis and reporting, provided such data cannot be used to identify You personally.
  9. After purchasing a Plan, You must download, install, and activate the corresponding eSIM on a carrier-unlocked, eSIM-compatible device. A stable internet connection is required for activation. Esimis designed as a global eSIM profile that may be used in supported destinations, subject to applicable Plan availability, coverage, Provider network conditions, and these Terms. You should keep the eSIM installed on Your device for as long as You intend to use or continue receiving Services from Esim io.
  10. It is solely Your responsibility to ensure Your device meets all technical specifications and is carrier-unlocked. Esim io accepts no liability for failed activations, device incompatibility, or carrier-specific restrictions.
  11. An eSIM profile is cryptographically bound to the first device on which it is installed and cannot be transferred, cloned, re-downloaded, or moved to another device (including via device migration tools), unless expressly enabled by the issuing carrier and the Platform. Device changes, loss, theft, damage, repair, or factory resets do not entitle You to a refund or credit. Esim io may, at its sole discretion, offer a one-time or limited reissue/replacement of an eSIM for use on the same or on a new device, subject to availability, carrier constraints, additional verification (including KYC/sanctions checks), technical feasibility, and fees. We may limit the number of reissues, reject a reissue request, or require the purchase of a new Plan or a fee for activation. Any reissued eSIM may invalidate the prior eSIM and may require fresh activation on the new device. If an eSIM fails to activate solely because the device is not eSIM-compatible or carrier-unlocked, Esim io may, at its sole discretion, provide either (i) a refund or (ii) a future service credit of equivalent value. Such remedy is contingent upon confirmation of non-compatibility and no prior activation attempt.
  12. Esim io may, at its discretion, also grant a one-time or limited reissue of an eSIM for use on a new device, subject to availability, technical feasibility, verification, and applicable fees. Any reissued or refunded eSIM invalidates the prior eSIM and requires new activation.
  13. You are responsible for any taxes, duties, or levies imposed in connection with Your purchase (excluding Esim io’s own income taxes). Where applicable, You must report and remit such amounts directly to the appropriate authorities.
7. Calling Service - Pay-As-You-Go Charges
  1. Calling Service charges are deducted from Your available Credits balance on a pay-as-you-go basis. The applicable Call Rate is displayed before the call and may vary by destination country and the type of line or number called.
  2. Although a Call Rate may be displayed as a price per minute, actual Calling Service usage is measured and charged per second. Charging begins only when the relevant telecommunications system records the call as connected and ends when the call is terminated. If the call is not recorded as connected, no Calling Service usage charge is deducted.
  3. Before a call is initiated, the Platform may display an estimated maximum call duration based on Your then-current Credits balance and the applicable Call Rate. This estimate is informational only and is not guaranteed. It may change if the same Credits balance is used by other chargeable Services or due to other balance changes, rate configuration, taxes, or technical factors disclosed in the Platform.
  4. If Your available Credits are insufficient to start or continue a call, the Calling Service may prevent the call from being initiated or will terminate an ongoing call when the available Credits balance is exhausted. No separate consent is required for such automatic termination.
  5. If a call is interrupted after it has connected, You will be charged only for the connected usage recorded up to termination. Connected Calling Service usage is non-refundable except in the case of a verified billing error or where a refund is required by Applicable Law. Calls that never connect are not charged.
  6. Calling Service rates and supported destinations may change prospectively for subsequent calls. The Call Rate shown to You immediately before initiating a call is the rate used as the basis for that call and will not be increased during that call. Applicable taxes, surcharges, exchange or credit-conversion treatment will be as expressly disclosed in the Platform. Unless expressly stated otherwise, charges are inclusive of VAT where required under these Terms and the Payment, Cancellation and Refund Policy.
  7. Esim io does not automatically top up Your Credits balance solely because You use the Calling Service unless You separately enable and authorize an automatic top-up or other recurring payment feature made available on the Platform.
Termination
1. The right to use the Services continues until terminated in accordance with these Terms. Esim io may modify, suspend or discontinue all or any part of the Platform or Services where reasonably necessary for legal, regulatory, security, fraud-prevention, network, Provider, technical, operational or commercial reasons, including where continued operation is no longer reasonably practicable. Where reasonably practicable and required by Applicable Law, Esim io will provide appropriate notice of a material discontinuation. Upon termination, the treatment of unused Credits, prepaid amounts and active Plans will be governed by the Payment, Cancellation and Refund Policy and Applicable Law. No refund will be due where suspension or termination results from non-payment, fraud, misuse or breach of these Terms, except where required by Applicable Law.
2. Esim io may immediately restrict, suspend or terminate Your access to the Platform, any Service or Your account, with or without prior notice where permitted by Applicable Law, if: (a) You materially breach these Terms or the Policies; (b) fraud, abuse, unauthorized use, sanctions risk or unlawful activity is reasonably suspected; (c) payment is overdue, reversed or charged back; (d) Your account, device or credentials appear compromised; (e) a Provider, competent authority or Applicable Law requires or reasonably necessitates the action; or (f) continued access creates a material legal, regulatory, security, network or operational risk. Any deletion, deactivation or retention of account data following termination is subject to the Privacy Policy, Applicable Law, legal-hold requirements and legitimate fraud, security and dispute-resolution needs.
3. You may request termination of Your account or Your right to access or use the Services at any time through the Platform. Account termination, deletion of the Application, removal of an eSIM or ceasing use of the Services does not, by itself, cancel any active Plan or Subscription, stop any recurring charge, or create any right to a refund, credit or redemption of unused Credits. Any Plan or Subscription must be cancelled separately through the applicable process and Sales Channel in accordance with the Payment, Cancellation and Refund Policy. Account termination will take effect only after Your request has been processed and may take up to thirty (30) days from the date of Your request. Once processed and confirmed, account termination is final and cannot be reversed.
4. You acknowledge that Esim io’s decisions to limit access, suspend, or terminate Services or accounts may be based on confidential risk management and security criteria, and we are under no obligation to disclose these procedures or criteria.
5. Esim io shall not be liable for any loss, damage, or harm arising from suspension or termination of the Services or Your account, to the extent permitted by applicable law.
6. Upon termination, all rights granted to You under these Terms shall immediately cease, and You must cease all use of the Services and delete or return all downloaded materials where practicable.
Force Majeure
1. Esim io shall not be liable for delay, failure or interruption caused by events beyond its reasonable control, including natural disaster, fire, flood, war, terrorism, civil disturbance, epidemic or pandemic, labour disruption not limited to Esim io’s own workforce, governmental or regulatory action, widespread power, internet, cloud or telecommunications outage, cyberattack, systemic infrastructure failure, withdrawal or suspension of numbering or network resources, or the failure or termination of a material Provider relationship where the effect could not reasonably have been avoided or overcome (each, a “Force Majeure Event”). During a Force Majeure Event, affected obligations are suspended to the extent and for the period prevented. Esim io may modify, suspend or discontinue the affected Service where reasonably necessary, subject to any mandatory refund, credit or consumer-remedy rights under Applicable Law and the Payment, Cancellation and Refund Policy. Provider cost increases or other ordinary commercial changes are addressed under Sections 2.8 and 2.9 and do not, by themselves, constitute a Force Majeure Event.
Entire Agreement
1. These Terms, including Annex 1 (Outbound Calling Specific Terms and Acceptable Use Rules), together with the Policies and any separate written terms expressly stated to supplement or supersede these Terms for a particular Service, constitute the entire contractual agreement between You and Esim io concerning the Services covered by them. The Privacy Policy and Cookie Policy are provided separately for transparency and compliance purposes as described in these Terms. Annex 1 forms an integral part of these Terms and is not a separate agreement. In the event of conflict, the order of precedence stated in Section 2.15.2 applies. Nothing in this Section excludes liability for fraud or fraudulent misrepresentation or limits any right that cannot lawfully be excluded.
Amendment
1. We may amend these Terms by publishing an updated version with its effective date. We will notify You of material changes through the Platform or by email before they take effect, and give any additional notice or obtain any consent required by Applicable Laws. No amendment applies retrospectively to completed transactions. Access to a new optional feature may require acceptance of the provisions applicable to that feature.
Waiver
1. Any failure or delay in exercising any right, power or privilege Esim io is granted under these Terms shall not be regarded as a waiver thereof.
Assignment
1. Any right and obligation of You under these Terms shall not be assigned or transferred to any third party without obtaining prior written consent of Esim io.
2. Esim io may assign, novate or transfer these Terms, or any rights or obligations under them, to an Affiliate or in connection with a merger, reorganisation, financing, corporate succession, or sale or transfer of all or substantially all of the business or assets to which the Services relate. Esim io may otherwise transfer these Terms to another service provider where the transfer does not materially reduce Your contractual rights, subject in each case to any mandatory notice, consent or other requirement under Applicable Law. Esim io may engage Affiliates and subcontractors to perform parts of the Services without transferring the contract itself.
Severability
1. If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be severed or, where legally permissible, applied with the minimum modification necessary to make it valid and enforceable while preserving its legitimate purpose. The remaining provisions will continue in full force and effect.
International Availability
1. Availability of the Services, including specific features, Plans and language versions, varies by country and may change at any time.
Privacy
1. Please refer to the Privacy Policy for information about how Esim io collects, uses, shares, retains and otherwise processes personal data in connection with the Platform and Services. Esim io implements technical and organisational measures designed to protect personal data as described in the Privacy Policy; however, no system, device, network or transmission method can be guaranteed to be completely secure. You are responsible for maintaining reasonable security over Your device, account credentials and access methods and for promptly notifying Esim io of suspected unauthorised access.
Code of Conduct
1. The Services offered through the Platform shall not be used for any purposes other than what is set out by the Company, in accordance with these Terms. In this regard, the Services are provided for and limited with personal, non-commercial, non-exclusive, limited, non-transferable use only.
2. Therefore, while accessing and/or using the Platform and the Services, (as an unrestrictive list) You are explicitly prohibited to and You shall NOT:
  1. Use the Platform and Services against any applicable laws, either local, federal, national, or international,
  2. Use the Services or Content to support, or engage in any illegal activities including, but not limited to, illegal gambling, fraud, money laundering, or terrorist activities,
  3. Use the Platform, Content or Services in a way that disrupt, adversely affect, prevent or obstruct provision of Services and use of Services by other users,
  4. Access without authorization to any Esim io IP or Content to which You are not permitted to access or use,
  5. Make any commercial use of the Services and Content, develop third party applications benefiting from Our Services and Content,
  6. Copy, decompile, disassemble or reverse engineer any software that is a part of the Platform, Content and Services,
  7. Use any spider, robot, cheat utility, scraper, offline reader or any other automated means that accesses the Platform and Esim io Content; use or launch any unauthorized script or other software; or upload any harmful software such as a virus or a Trojan horse,
  8. Attempt to interfere with or disable any features of the Platform, or create undue traffic or other burden on the Platform or related networks,
  9. Systematically retrieve any content or data from the Platform to create reference or compile such data to form a collection, compilation, database, or directory or use any infrastructure, software, application or other tool that acts as or constitute an information or data collection or transmission mechanism,
  10. Disclose private information pertaining to Platform, Services or the Company to third parties,
  11. Use the Platform to market, advertise or offer to sell goods or services,
  12. Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in the Platform or any material.
  13. Resell, sublicense, share, or re-route the Services including via tethering for commercial traffic aggregation except as expressly permitted.
  14. export/re-export the Services to prohibited destinations or parties.
  15. Attempt to avoid, bypass, manipulate, or disable any payment requirement, usage metering, or any mechanism.
  16. Use the Calling Service for unsolicited bulk calling, robocalling, automated or predictive dialing, call-center traffic, high-volume telemarketing, or other commercial calling activity unless expressly authorized by Esim io and permitted by Applicable Law;
  17. Harass, threaten, stalk, intimidate or abuse any person, including by repeatedly contacting a person contrary to their wishes or continuing to call after being asked to stop;
  18. Impersonate another person or organisation, falsely claim authority or affiliation, misrepresent the origin or purpose of a call, use any telephone number, account or verification information without authority, conduct phishing or scams, or otherwise seek money, credentials, payment information or other data by deception;
  19. Send spam or make unlawful unsolicited, marketing or promotional calls, disregard applicable consent, do-not-call or opt-out requirements, or use automated, scripted, predictive or bulk dialling except where expressly authorised by Esim io and permitted by Applicable Law;
  20. Manipulate, spoof, falsify or attempt to control caller identification, routing information, verification information, geographic eligibility or other technical identifiers associated with a call;
  21. Generate artificial traffic, traffic pumping, revenue-share arbitrage, repeated calls to premium-rate or special-tariff numbers, or other activity intended primarily to create charges, commissions, rebates or other financial benefit rather than genuine interpersonal communication;
  22. Resell, sublicense, share, aggregate or provide the Calling Service to third parties, including as part of a call-center, communications platform, trunking, wholesale or similar service;
  23. Circumvent or attempt to circumvent any destination block, usage limit, verification requirement, fraud-prevention control, sanctions control, or country restriction applied to the Calling Service;
  24. Use the Calling Service to make unlawful marketing or promotional calls, or to contact persons where the required consent, permission or lawful basis for such contact has not been obtained;
  25. Misuse emergency, public-safety, premium-rate, short-code or other specially regulated numbers or services, including testing or repeated calling without a genuine lawful purpose.
  26. Use the Calling Service to infringe another person’s privacy, confidentiality, intellectual property or other rights, including by unlawfully obtaining, using or disclosing personal data or communications;
  27. Misuse the Calling Service or any telecommunications functionality, including by generating artificial traffic or traffic pumping, engaging in toll fraud, revenue-share arbitrage or abusive revenue-sharing arrangements, disrupting or adversely affecting Esim io’s or any third-party telecommunications network, or bypassing, circumventing, manipulating or attempting to defeat any verification requirement, destination restriction, usage limit, metering mechanism, fraud-prevention measure or security control, including any control associated with OTP or telephone-number verification.
3. Any prohibited use of the Platform and Services may have serious legal and contractual consequences, including but not limited to the termination of Your use of Our Services, deletion of Your account, compensation of damages.
4. Esim io may suspend or terminate accounts, and take other actions it deems necessary to enforce these rules and protect the Platform integrity. For Calling Services measures reasonably necessary to address actual or reasonably suspected breaches of Section 14.2 may include blocking particular calls, destinations or accounts, limiting abusive traffic and requiring proportionate verification of account control or lawful use before restoring access. We may act immediately where prior notice would create a security, legal or network risk, subject to Section 11 of Annex 1. These measures do not automatically forfeit unused Credits or remove rights under the Payment, Cancellation and Refund Policy.
5. Esim io reserves the right, and may be legally required, to monitor, investigate, and report any suspected unlawful, abusive, fraudulent, or prohibited activity related to the Platform or the Services to competent governmental, regulatory, or law enforcement authorities. To the extent permitted by applicable law, Esim io may disclose relevant user information, transaction records, or communication logs to such authorities or to third-party compliance service providers assisting in fraud prevention, sanctions screening, or anti-money-laundering compliance. You acknowledge and agree that Esim io shall not be liable for any disclosure or action taken in good faith under this clause, and that such disclosures may be made without prior notice to You if required or authorized by law. All disclosures under this section shall be made in accordance with the Privacy Policy and applicable data-protection law.
6. You further represent and warrant that You are not (i) located in, ordinarily resident in, or accessing the Services from any jurisdiction or territory that is subject to comprehensive trade or economic sanctions or embargoes, or (ii) a person, entity, or organization listed on any sanctions-related restricted party list maintained by the European Union, the United Kingdom, the United States, or other applicable authorities. You shall not use the Platform or Services in violation of any applicable export control, sanctions, or anti-boycott laws or regulations.
7. Esim io and the relevant Merchant of Record reserve the right to reject, suspend, or cancel any transaction, and to withhold or deny any refund, replacement, or service delivery, if doing so would expose either party to a violation of such laws or regulations. Any approved refund will be processed through the original payment method by the relevant Merchant of Record and may take up to thirty (30) business days, depending on the payment processor’s policies, subject in all cases to any shorter mandatory deadline under Applicable Law.
Risk Disclosure
1. Access to eSIM provisioning, mobile data services and the Calling Service may degrade, fail, or become temporarily unavailable during periods of network congestion, high demand, software maintenance, carrier-side restrictions, routing failures, destination-network restrictions or other technical events. Such events may prevent or delay You from activating, recharging or using Your eSIM and may delay technical support. Calling Service calls may fail to connect, drop after connection, experience delay or reduced audio quality, or display a caller identification number that varies by Provider or destination network.
2. The Esim io Platform, user interface, and any related documentation or communications may contain inaccuracies, omissions, or outdated information regarding device compatibility, supported carriers, pricing, or country coverage.
3. Esim io relies on third-party carriers, network operators, telecommunications providers, numbering/routing providers and technology providers to deliver connectivity and the Calling Service. Termination of Our partnerships, material changes to their terms, network outages, regulatory interventions, destination blocks, numbering restrictions, technological shifts or other Provider actions may impair, suspend, modify, change the price of, or result in discontinuation of affected Services.
4. You expressly accept that neither Esim io nor its partners guarantee continuous service, and that You may experience service interruptions or degraded performance beyond Our control.
5. In the event of any dispute with other users, carriers, or content providers regarding plans or data usage, You release Esim io and its affiliates from all claims, liabilities, costs, and damages arising out of or relating to such disputes. To the maximum extent permitted by law, You release us from claims arising from disputes with other users or Providers related to Plans or usage.
6. We do not guarantee that Our Services will always be available or be uninterrupted. You are responsible for making all arrangements necessary for You to have access to Our Services.
7. We do not represent that Our Services will be available in other jurisdictions. We may limit the availability of Our Services or specific functionality to any user or geographic area at any time. You assume all risk and responsibility for compliance with any applicable telecommunications, data privacy, consumer protection, export control, or other laws associated with your use of the Service.
8. You will immediately see the purchased eSIM under the "My eSIMs" tab on the Platform. You will receive a confirmation email after the purchase. All the information for installing the eSIM will be available only on the Your Esim io account.
9. You acknowledge the inherent risk that installed eSIMs cannot be transferred to another device and that reissues are discretionary and may not be available in all cases or jurisdictions.
Your Obligations:

Without prejudice to the Terms of Service, the Your obligations are as follows:
1. Use the Service in compliance with these Terms of Service and to be responsible for all use of the Service from Your account,
2. Submit true, accurate, and complete registration information, and to keep such information up-to-date,
3. Keep the password confidential at all times and will be responsible for all use of the account and password. We reserve the right to remove, reclaim, or change a username You select if we determine, in Our sole discretion, that such username is objectionable,
4. Use the Service in accordance with all applicable laws and regulations of the home nation, the country of residence, and the country in which You are present when the Service is being used by You,
5. You agree to solely liable for the use of any prohibited and/or restricted services under any applicable laws and regulations of Your home nation, country of residence, and the country in which You are present when using the Services. You agree and accept to indemnify and hold Esim io harmless from any and all claims arising from and/or in relation to use of prohibited and/or restricted services,
6. You agree that it is solely liable for all responsibility to comply with any applicable telecommunications, data privacy, consumer protection, export control, or other laws associated with use of the Service.
7. You agree that the Service shall be used for personal consumption only,
8. You agree that the Service shall not be used to engage in any action that is abusive, illegal or fraudulent or that causes the network to be impaired or damaged,
9. You agree that the credits, promotions and referrals for the Services (the “Program”) shall not be used to undermine the fairness, integrity or legitimate operation of the Program, including but not limited to, creating fake accounts or using fictitious identities to participate in the Program or receive reward, sell. Esim io, in its sole discretion, reserves the right to disqualify You from the Program and future use of Our Services,
10. You agree that Esim io may suspend Your use of the Service in case of breach of the above obligations, and that You will continue to be liable and shall pay all charges due under these Terms of Service in respect of the suspended Services. Do note that any attempt to deliberately damage or undermine the legitimate operation of the Services and the Program may be in violation of criminal and civil laws,
11. You acknowledge that Esim io reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.
12. For the Calling Service, safeguard Your device, account credentials and verification codes, do not disclose them in a manner that enables unauthorized access, promptly notify support@esim.io of suspected compromise or unauthorized use, and reasonably cooperate with measures to secure the account and investigate misuse. You must use only telephone numbers and account information that You are entitled to use for verification.
Indemnification
1. You agree to defend, indemnify and hold harmless Esim io, its Affiliates, and each of their respective officers, directors, employees, agents, partners and licensors (collectively, the “Indemnified Parties”) from and against losses, liabilities, damages, judgments, settlements, and reasonable external legal fees and court costs arising from a third-party claim, or from a governmental or regulatory investigation or enforcement action, to the extent directly caused by or arising from:
  1. Your breach or alleged breach of these Terms or any representation, warranty or covenant made by You herein;
  2. Your unlawful, fraudulent, abusive, unauthorised or prohibited use of the Services, including the Calling Service, or any content, data or communications that You submit, transmit or cause to be transmitted through the Services;
  3. Any violation by You of applicable law, regulation or the rights of any third party (including intellectual property, privacy or publicity rights);
  4. Your negligent, wilful or reckless act or omission in connection with the Services, to the extent such conduct causes the relevant third-party claim or regulatory action;
  5. Your unauthorised deployment or use of automated calling, data-gathering, extraction, scraping, bot or similar tools that misuse the Services, impose an unreasonable load on Esim io or a Provider, or violate Applicable Law; or
  6. Any harmful, harassing, deceptive, infringing or otherwise illicit conduct by You toward another user, call recipient, telephone-number holder, Provider or other third party in connection with the Services.
  7. Esim io may, at its option, assume exclusive control of the defence and settlement of any matter subject to indemnification under this Section. You must provide reasonable cooperation at Your expense and must not admit liability or settle a covered claim without Esim io’s prior written consent. Esim io will not agree to a settlement that requires an admission of wrongdoing or imposes a non-monetary obligation directly on You without Your consent, not to be unreasonably withheld or delayed.
2. Without limiting Section 17.1, Your indemnification obligations include third-party claims by call recipients, telephone-number holders, telecommunications Providers, network operators or other affected persons arising from or relating to Your unlawful or unauthorized use of the Calling Service, Your breach of the calling-specific acceptable-use rules, Your unauthorized use of automated calling tools, Your use of verification information or telephone numbers without authority, or unauthorized calling that You cause or permit through a breach of Your account-security obligations.
3. The indemnification obligations in this Section do not apply to the extent a claim, loss, fine, penalty or cost is caused by an Indemnified Party’s own fraud, wilful misconduct or negligence, or to the extent the relevant amount cannot lawfully be indemnified or transferred to You under Applicable Law. Fines and penalties are recoverable only to the extent lawfully recoverable and directly attributable to conduct for which You are responsible under this Section.
Intellectual Property Rights
1. The Platform is the proprietary property of the Company and all content therein including but not limited to signs, text, graphics, pictures, information, data, software, sound files, source codes, databases, functionality, website designs, audio, video, text, photographs, and graphics and the trademarks, service marks, and logos (collectively, the “Esim io IP”) are owned by us and/or licensed to us and/or controlled by us; and are protected through various intellectual property rights.
2. The Esim io IP is provided on the Platform for the permitted use only, in accordance with these Terms. Therefore, copying, reproducing, republishing, uploading, aggregating, publicly displaying, encoding, translating, distributing, selling, licensing, reverse engineering or in any other way exploiting any part of the Platform and/or Esim io IP for any unauthorized and prohibited purpose, without express prior written permission of the Company is strictly prohibited.
3. You are granted a limited use right to access and use the Esim io IP, Platform and Services, provided that You are eligible to under these Terms. However, Esim io, at any time, reserves the right to terminate Your access to the Platform, the Services, the Esim io IP and if applicable revoke the use rights or licenses provided.
4. It is prohibited to give unauthorized links to the Platform and the Services as well as framing of any information contained on the Platform or any portion of the Platform. If any unauthorized link or framing is detected, Esim io reserves the right to disable the unauthorized links or frames right away or request for the link to be removed.
5. In any event, Esim io shall not be held responsible or liable for any material on third party websites which contains link to the Platform and the Services. Similarly, Esim io has no responsibility or liability for framing of any information contained on the Platform or any portion of the Platform.
6. It is prohibited to develop any third party applications that interact with Our Services or integrate Our Services into any third party applications through application programming interfaces (API) unless such license is explicitly granted. Separate license terms shall be executed in order for Esim io to grant any such license.
Disclaimer of Warranties
1. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ESIM IO AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, SECURITY, AVAILABILITY AND UNINTERRUPTED OPERATION, EXCEPT FOR ANY WARRANTY OR STANDARD OF PERFORMANCE THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

ESIM IO DOES NOT WARRANT THAT THE SERVICES OR ANY CONTENT OBTAINED THROUGH ESIM IO IS FREE OF VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS. WHILE ESIM IO IMPLEMENTS COMMERCIALLY REASONABLE TECHNICAL AND ORGANIZATIONAL SAFEGUARDS CONSISTENT WITH INDUSTRY STANDARDS, NO SYSTEM OR NETWORK IS COMPLETELY SECURE OR ERROR-FREE. YOU USE THE SERVICES AT YOUR OWN RISK AND ARE SOLELY RESPONSIBLE FOR MAINTAINING APPROPRIATE DATA BACKUPS, SECURITY CONFIGURATIONS, AND PROTECTIVE MEASURES ON YOUR DEVICES AND NETWORKS. YOU ARE RESPONSIBLE FOR IMPLEMENTING AND MAINTAINING APPROPRIATE DEVICE AND NETWORK SECURITY (E.G., OS UPDATES, ANTI-MALWARE, SECURE APN/CONFIGURATION) AND FOR SAFEGUARDING ACTIVATION QR CODES, INSTALLATION FILES, AND CREDENTIALS. YOU ACKNOWLEDGE THAT THE INTERNET, MOBILE NETWORKS, AND TELECOMMUNICATIONS SYSTEMS ARE INHERENTLY INSECURE AND SUBJECT TO INTERRUPTION, INTERCEPTION, LOSS, CORRUPTION, OR UNAUTHORIZED ACCESS BY THIRD PARTIES. ESIM IO MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, REGARDING (I) THE SECURITY OF ANY TRANSMISSION OF DATA OR COMMUNICATIONS THROUGH PUBLIC OR PRIVATE NETWORKS; (II) THE PREVENTION OF UNAUTHORIZED ACCESS, HACKING, MALWARE, OR OTHER SECURITY BREACHES; OR (III) THE INTEGRITY OR CONFIDENTIALITY OF ANY DATA TRANSMITTED, STORED, OR OTHERWISE PROCESSED THROUGH THE SERVICES.
5. WITHOUT LIMITING ANNEX 1, THE CALLING SERVICE DEPENDS ON COMPATIBLE DEVICES, INTERNET ACCESS, THIRD-PARTY CARRIERS, ROUTING AND NUMBER PROVIDERS, AND DESTINATION NETWORKS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ESIM IO DOES NOT GUARANTEE CONNECTION TO EVERY NUMBER, AN ANSWER BY THE RECIPIENT, UNINTERRUPTED CALLS, ANY PARTICULAR AUDIO QUALITY OR LATENCY, OR CONSISTENT CALLER-IDENTIFICATION DISPLAY OR ACCEPTANCE. CONGESTION, MAINTENANCE, FIREWALLS, CARRIER FILTERING, DESTINATION-NETWORK RESTRICTIONS AND COUNTRY-SPECIFIC CONTROLS MAY PREVENT, DELAY OR INTERRUPT CALLS. A DISPLAYED POOL NUMBER OR SUCCESSFUL TELEPHONE VERIFICATION DOES NOT VERIFY A CALLER’S IDENTITY, AUTHORITY OR TRUSTWORTHINESS.
6. ESIM IO IS UNDER NO OBLIGATION TO PROVIDE MAINTENANCE, SUPPORT, OR UPDATES EXCEPT AS EXPRESSLY STATED IN THESE TERMS; ANY SUPPORT PROVIDED IS AT ESIM IO’S SOLE DISCRETION.
7. YOU ACKNOWLEDGE AND AGREE THAT IT IS YOUR SOLE RESPONSIBILITY TO ENSURE THAT YOUR ACCESS TO AND USE OF ESIM IO COMPLIES WITH ALL APPLICABLE LOCAL, NATIONAL, AND INTERNATIONAL LAWS, REGULATIONS, AND LICENSING REQUIREMENTS. ESIM IO MAKES NO REPRESENTATION OR WARRANTY REGARDING THE LEGALITY OF YOUR USE OF ESIM IO IN ANY JURISDICTION, AND YOU ASSUME ALL RISK AND LIABILITY IN THIS REGARD.
8. ESIM IO EXPRESSLY DISCLAIMS ANY LIABILITY FOR LEGAL COMPLIANCE OR NON-COMPLIANCE BY USERS. UNDER NO CIRCUMSTANCES SHALL ESIM IO BE RESPONSIBLE FOR DETERMINING OR ENSURING THAT YOUR ACCESS TO OR USE OF THE SERVICES CONFORMS TO ANY LEGAL OR REGULATORY REQUIREMENTS IN ANY JURISDICTION.
9. TO THE EXTENT THAT ANY WARRANTY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, SUCH WARRANTY SHALL BE LIMITED IN DURATION TO THE SHORTEST PERIOD PERMITTED BY LAW.
Limitation of Liability
1. To the fullest extent permitted by Applicable Law, Esim io, its Affiliates, officers, directors, employees, agents and licensors shall not be liable for any indirect, incidental, special, punitive or consequential loss or damage, or for loss of profit, revenue, business, anticipated savings, goodwill, opportunity, data or business interruption, arising out of or relating to these Terms or the Services, whether in contract, tort (including negligence), strict liability or otherwise, even if advised of the possibility of such loss, except to the extent such exclusion is prohibited by Applicable Law.
2. Notwithstanding the foregoing, Esim io’s total aggregate liability for any and all claims arising out of or relating to these Terms or the Services, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the greater of (a) the total amount of fees actually paid by You to Esim io for the specific Services giving rise to the claim in the one (1) month preceding the claim, or (b) five U.S. dollars (USD 5).
3. Nothing in these Terms excludes or limits liability to the extent it cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, or any other liability that Applicable Law requires to remain uncapped. If You are a consumer, nothing in these Terms limits any mandatory right to services performed with reasonable care and skill, any mandatory remedy for non-performance or defective performance, any mandatory data-protection right, or any minimum monetary remedy or liability floor that Applicable Law does not permit the parties to reduce.
4. You acknowledge that these limitations of liability are fundamental elements of the agreement between You and Esim io, and that Esim io would not be able to provide the Services on an economic basis without such limitations. Esim io is under no obligation to provide maintenance, support, or updates except as expressly stated in these Terms. Any support provided is at Esim io’s sole discretion.
5. You acknowledge and agree that it is your sole responsibility to ensure that your use of Esim io complies with all applicable local, national, and international laws, regulations, and licensing requirements. Esim io makes no representation or warranty regarding the legality of your use of Esim io in any jurisdiction, and You assume all associated risk and liability.
6. Without limiting Sections 20.1 to 20.5, to the fullest extent permitted by Applicable Law, Esim io shall not be liable for loss to the extent caused by Your misuse of the Calling Service, Your failure to safeguard Your account, device or verification credentials, failures or limitations of Your device or internet connection, or the independent acts, omissions, outages, routing failures, restrictions or performance of external telecommunications networks or Providers for which Esim io is not legally responsible. For the avoidance of doubt, the aggregate liability limit in Section 20.2 applies collectively across all claims relating to the Calling Service and does not create a separate liability cap for each call, telephone number, destination or Provider. Nothing in this Section limits liability that cannot be limited or excluded under Section 20.3 or Applicable Law.
7. The Services are supplied for personal and non-commercial use. To the fullest extent permitted by Applicable Law, Esim io is not liable for business losses, loss of profit, revenue, anticipated savings, business opportunity, goodwill or business interruption resulting from use of the Services for any business, professional, resale or other commercial purpose contrary to these Terms.
8. Esim io is not liable for loss to the extent the loss was not caused by Esim io’s breach of these Terms, was caused or increased by Your act or omission, device, connectivity or failure to follow reasonable instructions, or could reasonably have been avoided by You. No party may recover more than once for the same loss. This Section does not reduce any mandatory consumer remedy or shift to You responsibility that Applicable Law requires Esim io to retain for its own performance or for a Provider used to perform Esim io’s contractual obligations.
Applicable Law and Jurisdiction
1. These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-laws rules. If You are a consumer, this choice of law does not deprive You of any mandatory protection afforded by the law of Your habitual residence that cannot validly be excluded by agreement.
2. The courts of England and Wales shall have exclusive jurisdiction over disputes or claims arising out of or in connection with these Terms. Nothing in this Section prevents a consumer from bringing or defending proceedings in any court that Applicable Law mandatorily permits or requires.
Third Party Contents
1. There may be references and links to third party websites and applications on the Platform and/or You may view content provided by third party websites and applications while using the Services (“Third-Party Content”).
2. We have no control over Third Party Content. You hereby acknowledge and agree that Esim io has no responsibility to examine, control, endorse or monitor any Third-Party Content. Third Party Content may be misleading, incomplete, erroneous, offensive or indecent. When You click on a link to, or access and use, a third-party website or third-party application, though we may not warn You that You have left Our Service, You are subject to the terms and conditions (including privacy policies) of another website or destination. We are not responsible or liable for any third-party websites, third party applications, and third-party materials. You shall use all links at Your own risk.
3. You view Third Party Content at Your own risk and Esim io will not be held liable for any loss or damage arising out of Third-Party Content or services.
4. It is Your responsibility to read and accept the terms and conditions and policies of any third-party website or application.
Language and Translation
1. These Terms are originally drafted in English. Any translation of these Terms into another language is provided solely for convenience. In the event of any conflict, inconsistency, or ambiguity between the English version and any translated version, the English version shall govern and prevail. The English version shall be used in all legal or administrative proceedings.
Notices
1. Esim io may provide service and contractual notices by email to the latest email address associated with Your account, through in-product or Platform messaging. A notice is deemed received when it is made available through the relevant channel, except that an email known by Esim io to have failed or bounced will not be deemed received solely because it was sent. Any mandatory rule governing form, timing, advance notice or durable-medium delivery prevails. You are responsible for keeping Your contact details current.
Third-Party Rights
1. Esim io’s Affiliates and the Indemnified Parties are intended beneficiaries of Sections 17 (Indemnification), 19 (Disclaimer of Warranties), 20 (Limitation of Liability) and any other provision that expressly confers a benefit on them, and may enforce those provisions under the Contracts (Rights of Third Parties) Act 1999. Except as expressly stated in this Section, a person who is not a party to these Terms has no right under that Act to enforce any term. The parties may amend, terminate, rescind or vary these Terms without the consent of any third-party beneficiary, subject to Applicable Law.
Subcontracting and Service Providers
1. Esim io may use Affiliates, carriers, network operators, telecommunications providers, payment providers, verification providers, cloud providers and other subcontractors or service providers to perform any part of the Services. Such engagement does not create a contract between You and the relevant subcontractor unless the Platform expressly states otherwise. Nothing in this Section excludes or limits any responsibility that Applicable Law requires Esim io to retain for performance of its contractual obligations.
Survival
1. Any provision which by its nature is intended to survive termination or expiry of these Terms will continue in effect, including provisions concerning accrued payment obligations, fraud and abuse, intellectual property, indemnification, warranty disclaimers, limitation of liability, governing law and jurisdiction, third-party rights, dispute-related records and cooperation, and any rights or liabilities accrued before termination.

ANNEX 1 - OUTBOUND CALLING SPECIFIC TERMS AND ACCEPTABLE USE RULES

This Annex 1 (Outbound Calling Specific Terms and Acceptable Use Rules) (“Calling Annex”) forms an integral and inseparable part of the Esim io Terms of Service (“Terms”) and applies when You access or use the outbound voice calling feature made available through the Esim io Platform (the “Calling Service”). Acceptance of the Terms constitutes acceptance of this Annex 1 as part of the same agreement; no separate acceptance of this Annex 1 is required unless Applicable Law requires a separate consent, acknowledgement or other procedure. Capitalized terms not defined in this Annex 1 have the meanings given in the Terms. If there is a conflict concerning the Calling Service, this Annex 1 governs the feature-specific operational and acceptable-use matter, except that payment, billing, cancellation and refund mechanics remain subject to the Payment, Cancellation and Refund Policy and the main body of the Terms otherwise continues to apply.

1. Nature and Availability of the Calling Service

1.1. The Calling Service is an optional, internet-based, pay-as-you-go outbound voice calling feature. It enables You to initiate calls to supported telephone numbers in national or international numbering plans. It is not included in a data Plan unless expressly stated otherwise. The Calling Service does not itself provide a data allowance or activate an eSIM. Any eligibility, compatibility or other technical requirements applicable to the Calling Service will be shown on the Platform.

1.2. The Calling Service is outbound only. It does not provide inbound calling, SMS, a dedicated personal telephone number, number ownership or number portability.

1.3. Availability may vary by country, destination, line type, telecommunications Provider, regulatory requirements, network conditions, account status and verification status. Esim io may block, restrict, suspend or discontinue particular countries, destinations, number categories or Calling Service functionality where Esim io reasonably considers this necessary or appropriate for legal, regulatory, security, fraud-prevention, network, Provider, operational or commercial reasons, subject to Applicable Law.

2. Calling Numbers and Caller Identification

2.1. Calls may be originated using telecommunications numbers or number ranges used by Esim io and/or its Providers. Those numbers are not assigned exclusively to You and may be shared across users or calls.

2.2. The caller-identification number presented to the recipient may vary, may be a non-local or unfamiliar number, may not identify You personally and does not accept return calls. You have no right to select, control, retain, port, receive calls on, or otherwise use any caller-identification number outside the Calling Service. Presentation of a pool number is subject to network, Provider and country restrictions and does not guarantee anonymity.

2.3. You must not attempt to alter, spoof, falsify or manipulate caller-identification or routing information.

3. Rates, Credits and Call Charging

3.1. Calls are charged against Your available IO Credits on a pay-as-you-go basis. The applicable rate is shown before You initiate the call and may vary by destination country and the type of line or number called.

3.2. A rate may be displayed as a per-minute rate for ease of comparison. Actual usage is measured and charged per second. Charging starts only when the call connects and stops when the call terminates. No Calling Service usage charge is deducted for a call that does not connect. Telecommunications records used to determine connection and duration remain subject to correction of billing errors. For clarity, connected call duration is charged on a per-second basis without rounding the duration up to a whole minute.

3.3. The Platform may show the maximum call duration You are estimated to be able to make with Your then-current Credits balance. This is an estimate only and is not guaranteed. The estimate may change if other chargeable Services use the same Credits balance or if Your available balance changes for any other reason. If Your Credits balance is insufficient to start a call, the call may be blocked; if Your Credits balance is exhausted during a call, the call will automatically terminate.

3.4. If a call is interrupted after connection, You are charged only for the connected usage recorded up to termination. Connected usage is non-refundable except for a verified billing error or where required by Applicable Law. Billing corrections are handled under Section 4.7.5 of the Terms and the Payment, Cancellation and Refund Policy.

3.5. Rates and supported destinations may change prospectively for subsequent calls. The rate shown immediately before You initiate a call is the rate used as the basis for that call and will not be increased during that call. Applicable taxes, surcharges, currency or Credits-conversion treatment will be as disclosed in the Platform and the Payment, Cancellation and Refund Policy.

4. Permissions and Device Data

4.1. Microphone permission is required to place a call. Your voice audio is processed and transmitted in real time as technically necessary to establish and carry the call. If microphone permission is refused or withdrawn, voice transmission and use of the Calling Service may not function.

4.2. Contacts permission is optional. If granted, the app may read Your address book locally on Your device to help You select a number quickly. Esim io does not upload or store Your address book or contact names merely because You grant contacts permission. You may manage contacts and microphone permissions through Your device settings. Refusing contacts access does not prevent You from manually entering a telephone number. If You select a contact and make a call, the selected telephone number is transmitted as the called number to provide the call.On Android devices, telephone or device-state permission may also be requested where reasonably necessary to manage device or line status, network quality, or audio conflicts with a regular mobile call; the permission request will identify its purpose.

5. No Call Recording or Transcription by Esim io

5.1. Esim io does not record, store or transcribe the content of Calling Service calls as part of the current Calling Service.

5.2. Call audio is nevertheless transmitted through telecommunications networks and Providers in real time. Providers may independently process communications or related data where technically necessary or where required by telecommunications, security, lawful-interception or other Applicable Law.

6. Call History and Privacy

6.1. Esim io processes the called number, call date and time, duration and call status in order to display call history, administer and bill the Calling Service, provide support, investigate billing issues, prevent fraud and abuse, resolve disputes and comply with Applicable Law. Call History Data is stored in the Esim io database, and the telephone number You enter or select is processed as necessary for call routing, charging and call-history functionality.

6.2. The handling, sharing and retention of personal data associated with the Calling Service is described in the Privacy Policy. The current planned retention period for Call History Data is up to five (5) years, subject to Applicable Law and periodic necessity and data-minimisation review.

7. Verification, Fraud Prevention and Security

7.1. Esim io may require telephone-number or other proportionate verification for selected countries, accounts, destinations,usage patterns for fraud prevention or applicable telecommunication requirments Verification may be performed through OTP services, and the requirement may vary by country. You must be entitled to use any telephone number or account information submitted for verification. Failure to complete required verification may prevent or restrict use of the Calling Service. Verification does not assign the verified number to You for purposes of the Calling Service and does not make that number Your caller-identification number. Esim io will explain the applicable verification requirement before requesting the relevant information.

7.2. Esim io may delay, block, limit, suspend or terminate access to the Calling Service where required verification is not completed or cannot be validated, where fraud, abuse or other prohibited use is reasonably suspected, where a Provider or competent authority requires a restriction, or where Esim io reasonably considers that use creates legal, regulatory, security, network, operational or financial risk.

8. Third-Party Telecommunications Infrastructure

8.1. The Calling Service relies on third-party telecommunications carriers, network operators, routing and numbering providers and other infrastructure providers, including Three where used. These Providers may determine or affect routing, caller identification, connectivity, destination availability, service quality and network restrictions. The internet connection used for a call may separately consume data under Your data Plan or may result in charges from Your internet or connectivity provider; any such data consumption or connectivity charge is separate from the Calling Service charge.

8.2. Network, Provider or destination failures may cause calls not to connect, not to be answered, to drop, to experience delay or latency, reduced audio quality, or different caller-identification display or acceptance. Firewalls, carrier filtering, network congestion, maintenance, destination restrictions or country-specific controls may also prevent or interrupt calls. Esim io does not guarantee uninterrupted availability, successful completion or answer of every call, any particular caller-identification number or its acceptance by the recipient network, any particular level of audio quality or latency, or the availability of any particular destination or number type. A displayed pool number or successful telephone verification does not verify the caller’s identity, authority or trustworthiness.

8.3. To the fullest extent permitted by Applicable Law, Esim io is not responsible for, and disclaims liability arising from, the independent acts, omissions, availability, performance, network quality, routing, numbering, restrictions, outages or service failures of any Provider or destination network, except to the extent directly caused by Esim io’s own breach or where such liability cannot lawfully be excluded or limited.

8.4. Providers may change pricing, routing, availability, number ranges, restrictions or service coverage, or may suspend or discontinue services. Esim io may accordingly restrict, suspend, modify, reprice or discontinue affected Calling Service functionality or destinations to the extent permitted by Applicable Law. Any remedy for Provider-caused interruption, modification or discontinuation is subject to the limitations and remedy provisions in the main body of the Terms and the Payment, Cancellation and Refund Policy.

9. Emergency Communications

9.1. The Calling Service is not intended to replace a primary telephone service.No emergency calling. CALLING SERVICES DO NOT SUPPORT EMERGENCY CALLS OR EMERGENCY TEXTS, INCLUDING TO 112, 911 OR 999. They are not a replacement for a primary telephone service. You must maintain an alternative means of contacting emergency services and must not rely on Calling Services in an emergency. This limitation does not exclude any obligation that Applicable Laws impose on Esim io or its Providers.

9.2. You must not rely on the Calling Service for emergency communications and must maintain an alternative means of contacting emergency services.

9.3. Nothing in this Annex 1 limits any mandatory obligation to provide access to emergency services where such obligation applies under Applicable Law.

10. Acceptable Use and Community Rules

10.1. You must use the Calling Service lawfully, responsibly and for genuine personal communications. Use of a shared or pool caller-identification number does not relieve You of responsibility for Your conduct or Your compliance with Applicable Law. Without limiting the Terms, You must not:

(a) use the Calling Service for unsolicited bulk calling, robocalling, automated or predictive dialing, call-center traffic, high-volume telemarketing or other commercial calling activity unless expressly authorized by Esim io and permitted by Applicable Law;

(b) harass, threaten, stalk, intimidate, abuse or repeatedly contact a person contrary to their wishes or Applicable Law;

(c) impersonate another person or organization, misrepresent the origin or purpose of a call, conduct phishing or scams, or seek credentials, payment information or other data by deception;

(d) manipulate, spoof or falsify caller identification, routing information, verification information, geographic eligibility or other technical identifiers;

(e) generate artificial traffic, traffic pumping, revenue-share arbitrage, repeated premium-rate or special-tariff traffic, or other activity primarily intended to create charges, commissions, rebates or financial benefit rather than genuine communication;

(f) resell, sublicense, share, aggregate or provide the Calling Service to third parties, including through a call-center, communications platform, trunking, wholesale or similar service;

(g) circumvent or attempt to circumvent destination blocks, usage limits, verification requirements, fraud-prevention controls, sanctions controls or country restrictions;

(h) make unlawful marketing or promotional calls or contact persons where Applicable Law requires consent, permission or another lawful basis that You have not obtained; or

(i) misuse emergency, public-safety, premium-rate, short-code or other specially regulated numbers or services.

(j) infringe another person’s privacy, confidentiality, intellectual property or other rights through the Calling Service, including by unlawfully obtaining, using or disclosing personal data or communications.

11. Enforcement

11.1. Esim io may use Call History Data, transaction records, verification outcomes, Provider risk signals, user complaints and other non-content signals reasonably necessary to detect and investigate prohibited, fraudulent, abusive or abnormal use. Esim io does not rely on routine recording or transcription of call content for enforcement because the current Calling Service does not record or transcribe calls.

11.2. To the extent permitted by Applicable Law, Esim io may impose limits, block destinations or number categories, require additional verification, delay or refuse calls, suspend or terminate the Calling Service or the account, preserve relevant records, cooperate with Providers, and report suspected unlawful activity to competent authorities or Providers where permitted or required by Applicable Law. Esim io may take such action without prior notice where prior notice would create or increase a legal, regulatory, security, fraud-prevention or network risk. Where reasonably practicable and lawful, Esim io will provide information about the relevant restriction and how You may contact support; however, Esim io is not required to disclose confidential fraud-prevention, security, network-management or risk criteria.

12. Changes and Relationship with Other Terms

12.1. Esim io may amend this Annex 1 together with or separately from other parts of the Terms in accordance with Section 8 (Amendment) of the Terms, including to reflect changes in the Calling Service, Providers, pricing mechanics, law, regulatory requirements, security, fraud-prevention or operational requirements.

12.2. The main body of the Terms, Privacy Policy and Payment, Cancellation and Refund Policy remain applicable. If You stop using the Calling Service, those documents continue to govern any other Services You use. The Payment, Cancellation and Refund Policy also governs Calling Service billing corrections, cancellations, refunds and any applicable statutory withdrawal rights. Provisioning or activation of an eSIM or data Plan does not, by itself, waive or remove any rights that Applicable Law provides in relation to Calling Service charges or unused Credits.

12.3. You may stop using the Calling Service at any time without, by itself, cancelling or terminating any data Plan or other Service that remains active under the Terms.
